Immigration compliance has entered a new era. Laws written for the industrial age now govern digital-age employers — and enforcement has evolved into a data-driven, intelligence-led system. The result is the compliance paradox: perfect paperwork no longer guarantees protection. And, in a landscape where enforcement measures governance, not documentation, true compliance means aligning systems, behavior and intent. In our latest blog, Partner K. Edward Raleigh explores why immigration compliance can no longer be treated as a back-office function. As global frameworks tighten and enforcement intensifies, organizations must move toward proactive, governance-led models that strengthen risk management and support strategic workforce planning. Eddie outlines practical steps employers can take to build resilience, enhance cross-border transparency and align immigration oversight with broader business objectives. Partner R. Blake Chisam shares insights with Global Mobility Lawyer on the US Department of Homeland Security’s proposal to dramatically expand biometric data collection and continuous vetting under US immigration law. The rule would authorize ongoing monitoring of foreign nationals, extend biometric requirements to US citizens involved in immigration filings and broaden the types of data collected—including facial and voice recognition, iris scans and partial DNA profiles. To that end, Blake also cautions employers to prepare for increased data-privacy and compliance responsibilities.
