Read on to learn more about how the case underscores that economic losses tied to the fear of future harm, such as medical monitoring costs, cannot substitute for a present physical injury. https://lnkd.in/g93uT_8P Authors: Lee K. A McGuireWoods LLP litigation team won an important legal victory in their fight to preserve vital #healthcare funding for 21 autistic children and their families in North Carolina, persuading a state court to block a steep cut in #Medicaid reimbursement rates for essential therapy. Because of a state budget impasse, the North Carolina Department of Health and Human Services cut Medicaid reimbursement rates by 10% for applied behavior analysis (ABA) therapy, effective Oct. 1, 2025. On behalf of the children and their families, McGuireWoods filed a lawsuit challenging the cuts, arguing that the reductions are unconstitutional and discriminatory because they disproportionately impact children with disabilities. A Wake County Superior Court judge issued a preliminary injunction on Nov. 10, 2025, halting the funding cuts while litigation continues. A week earlier, McGuireWoods secured a temporary restraining order that ensured uninterrupted access to ABA therapy while the court considered the firm’s request for further relief. “We are proud to stand with North Carolina families and fight for the rights of children with autism to ensure they receive the care they need,” said Raleigh partner Michael Easley. The McGuireWoods legal team includes Easley, Raleigh partners Mark Anderson, Jonathan Ellis and Ryan Park, and associates Brent McKnight Jr. and Hannah Caison. https://lnkd.in/gX4Qjm4h

The Raleigh The News & Observer, NC Newsline, The Carolina Journal and Spectrum News covered another important litigation victory for a McGuireWoods LLP team fighting to preserve vital healthcare funding for 21 autistic children in the state. On behalf of the children and their families, McGuireWoods challenged a 10% cut in North Carolina’s Medicaid reimbursement rates for applied behavior analysis therapy, arguing that the reductions are unconstitutional and discriminatory. A Wake County Superior Court judge issued a preliminary injunction Nov. 10, 2025, blocking the funding cuts while the lawsuit continues. A week earlier, the McGuireWoods team won a temporary restraining order pausing the reductions until the court heard arguments on the firm’s request for a preliminary injunction. The McGuireWoods team includes partners Michael Easley, Mark Anderson, Jonathan Ellis and Ryan Park; and associates Brent McKnight, and Hannah Caison. “Our case argues that state budget challenges are no grounds to deny children with autism the legal right to services. Every disabled child has the right to live, learn and grow to their full potential in their community, not in an institution,” Easley told Spectrum News. https://lnkd.in/gUJagzSe
