Does it really matter who signs our employee's noncompete agreement? Yes. Recently, a Massachusetts Superior Court Judge refused to enforce a noncompete against an employee because the other signatory was the employer’s parent company, not the employer itself. Therefore, the judge concluded that the noncompete was unenforceable for not complying with the strict Massachusetts Noncompetition Agreement Act.
